Terms of Service

The basis on which we provide inspection services, and on which you may use this website.

Draft, pending legal review.

This text was prepared as a starting point and has not yet been reviewed by legal counsel. Last updated 21 September 2026.

1. About these terms

These terms explain the basis on which M-Grand Inspection Agency provides its services and the basis on which you may use this website.

The agency is:

Where we sign a separate written inspection agreement or accepted quotation with you, that document governs the work. These terms apply to the website and fill any gap the signed document leaves.

2. What the service is

M-Grand Inspection Agency provides independent garment quality inspection, factory audit, garment measurement, production monitoring and corrective action management.

An inspection is a professional check of goods, processes or facilities against requirements you have given us in writing. Those requirements normally include your approved sample, your specification sheet, your tolerances and your purchase order.

An inspection describes what the inspector observed, at the place and on the date of the inspection, against those requirements. It is not a warranty, guarantee or certification of the goods.

Where sampling is used, the findings describe the sample drawn. Sampling inspection gives a statistical basis for an accept or reject decision on the lot. It does not confirm that every unit in the lot is free of defects.

Responsibility for the quality, safety, legality and compliance of the goods stays with the manufacturer and the buyer. Our work does not transfer that responsibility to us.

3. Quotations, scope and prices

Prices shown on this website are indicative starting rates. They are not an offer and they are not binding.

Actual pricing depends on location, inspection scope, quantity, travel requirements and complexity.

Before any work starts we issue a written quotation setting out the scope, the standard to be applied, the deliverables and the fee. Work begins only once you accept that quotation in writing.

If the scope changes after acceptance, for example because the lot size, the location or the number of inspection days changes, we will quote the change before carrying it out.

A booked inspection that is cancelled or postponed at short notice, or an inspection the inspector cannot carry out because the goods or the factory are not ready, may be charged. The applicable notice period and charge are set out in the accepted quotation.

For legal review
Confirm the cancellation and no-show policy.

4. Payment terms

For legal review
Payment terms to be confirmed with the agency’s legal and tax advisers before publication. Also confirm the invoice period, accepted payment methods, currency, late payment charge, tax treatment and VAT position.

Fees are payable before or at defined service stages, as set out in the accepted quotation. Fees are invoiced against that quotation and are payable in the currency and within the period stated on the invoice. The agency may withhold a report until the applicable fee is paid.

5. Independence and impartiality

Our value to you depends on our independence, so we protect it.

Our findings are objective and based on the documented requirements you give us. We report what the inspector observed, whether or not it is what you hoped to read.

We do not accept payment, hospitality or any other benefit from a factory or supplier in connection with an inspection we carry out for you.

We do not manufacture, trade in, or hold an interest in the goods we inspect. Where a conflict of interest arises or might appear to arise, we tell you before the work starts and we may decline the engagement.

We do not change a finding because a factory, supplier or customer asks us to. We will correct a factual error in a report when it is shown to us.

6. Confidentiality

Customer, factory and product information given to us is treated as confidential. We use it only to carry out the work you have commissioned.

We do not disclose it to any third party except to the inspector assigned to your work, to a service provider acting on our instructions, or where the law requires disclosure.

Our inspectors are engaged under confidentiality obligations.

We will sign your own non-disclosure agreement where you need us to.

7. Reports

Reports are issued to the customer who commissioned the work. They are prepared for that customer and for the order they describe.

You may share a report within your own organisation and with your supplier for the purpose of resolving the findings.

A report may not be published, used in advertising, or presented as an endorsement of a factory, supplier or product without our written agreement. You may not edit a report or quote from it in a way that changes its meaning.

Photographs and measurement records supporting a report are kept as part of our records.

8. Your responsibilities

To do the work properly we need you to:

  • Give us complete and accurate requirements, including the approved sample, specification, tolerances and packing instructions
  • Confirm that the factory has agreed to grant our inspector access on the agreed date
  • Tell us promptly of any change to the order, the schedule or the location
  • Raise any question about a report with us within a reasonable period of receiving it

We are not responsible for delay or additional cost caused by incomplete requirements, by access being refused or by goods not being ready.

9. Limitation of liability

For legal review
Limitation of liability to be settled with the agency’s legal adviser and insurer before publication. Confirm the cap, the excluded heads of loss, the claim notification period and the professional indemnity cover that supports it.

The intended position is that the agency’s total liability arising out of an engagement is limited to a defined multiple of, or cap based on, the fee paid for that engagement, and that the agency is not liable for indirect or consequential loss, loss of profit, loss of contract or loss of reputation. Nothing in these terms limits any liability that cannot lawfully be limited or excluded under Kenyan law.

10. Accreditation status

Nothing on this website implies that M-Grand Inspection Agency is an accredited inspection body.

M-Grand Inspection Agency is not accredited to ISO/IEC 17020 and does not hold accreditation from any accreditation body. No statement, page, report sample or figure on this website should be read as a claim of accreditation, certification or approval by any third party.

Where this website refers to ISO 2859-1, it refers to the sampling procedure used when carrying out attribute sampling inspection. Applying a published sampling standard is not accreditation and is not certification.

The agency intends to develop its quality management system over time and will consider formal accreditation when the scale of the business justifies it. Any accreditation actually obtained will be stated plainly on this page.

The content of this website is provided for general information about our services. We take care to keep it accurate, but we do not warrant that it is complete or current.

The sample report figures shown on this website are illustrative. They do not describe a real inspection, a real lot or a real customer.

We may change the website, and these terms, at any time. The date at the top shows when these terms last changed.

12. Governing law and jurisdiction

These terms, and any engagement with M-Grand Inspection Agency, are governed by the laws of Kenya.

The courts of Kenya have exclusive jurisdiction over any dispute arising out of them, unless the accepted quotation or a signed agreement between us provides otherwise.
